Terms and Conditions of Use for EU Users

Please read these Terms carefully. By using Sine or signing up for an account, you’re agreeing to these Terms, which will result in a legal agreement between you and Sine.

Sine Technologies Limited – Terms of Use for EU Users

For Users based in the European Union, European Economic area or the United Kingdom the additional EU Processing Terms the following additional terms shall apply (in addition to the Sine Terms available here).

EU Processing Terms

Sine Technologies Limited (incorporated in Ireland with company registration number 610962 “Sine Ireland”) shall be the data controller and data exporter. Sine Group Pty Ltd (incorporated in Australia under company registration number ACN: 167 296 219 “Sine Australia”) shall be the data importer and data processor.

1. Sine Ireland and Sine Australia shall:

(a) process end User personal data only:

(i) for the purpose of performing its obligations in connection with the Sine Terms of Use;
(ii) in accordance with the User’s prior written instructions. In the event that the Sine believes that the User’s instructions conflict with the requirements of Data Protection Laws, the Supplier must immediately inform the User; and
(iv) in accordance with applicable laws.

(b) implement appropriate technical, security and organisational measures to protect the User’s personal data against unauthorised or unlawful processing and against accidental loss, destruction, damage, alteration or disclosure.

(c) not otherwise modify, amend, remove or alter the contents of the personal data or disclose or permit the disclosure of any of the personal data to any third party without the prior written authorisation of the User;

(d) maintain up to date records of its processing activities performed on behalf of the User which shall include the categories of processing activities performed, information on cross border data transfers and a general description of security measures implemented in respect of processed data;

(e) unless otherwise required by applicable law, return or delete all personal data upon the termination of the processing activities carried out in connection with the Sine Terms of Use;

(f) ensure that only those personnel who need to have access to the personal data are granted access to such personal data (and only in connection with the Sine Terms of Use) and that such personnel are subject to a duty of confidentiality;

(g) not appoint a new sub-processor without the prior written consent of the User, not to be unreasonably withheld, and ensure an agreement is entered into with the relevant sub-processor which includes terms which are substantially the same as the terms set out in these EU Processing Terms. For the avoidance of doubt, the User consents to the transfer of data within the Sine group;

(h) co-operate with the User if a data subject exercises any rights under applicable laws;

(i) notify the in the event it becomes aware (and no later than 24 hours after becoming aware) of any breach of applicable laws relating to the personal data or any loss of breach of personal data;

(j) assist the User should the User need to carry out a privacy impact assessment; and

2. Sine Ireland may export personal data to Sine Australia (and therefore outside of the European Economic Area (EEA), in accordance with the Standard Contractual Clauses entered into between Sine Ireland and Sine Australia dated 22 September 2017, a copy of which can be viewed here.
