For Users based in the USA, the following additional terms shall apply (in addition to the Sine general terms available here (“General Terms”)). To the extent of any inconsistency between the following additional terms and the General Terms or Sine’s Privacy Policy, the following additional terms shall prevail.
(a) for the purposes of this Agreement, Sine’s “Services” include, but are not limited to, the Website and all required activities to maintain, service, and improve the Website; Sine’s mobile applications and all required activities to maintain, service, and improve the mobile applications; deidentification of data; promotion of the Services; distribution of informational and promotional content; and any other functions described in these Terms performed by Sine on behalf of Clients; and
(b) to the extent that Sine collects or Processes Personal Information in connection with performing functions on behalf of Client specified in these Terms, Sine agrees that:
(i) Sine will not:
(A) sell the Personal Information;
(B) retain, use, or disclose the Personal Information for any purpose other than to provide the Services or as required by law, including retaining, using, or disclosing the Personal Information for a commercial purpose other than performing the Services; or (A) sell the Personal Information;
(C) retain, use, or disclose the Personal Information outside of the direct business relationship between Sine and Client;
(ii) Sine shall reasonably assist Client to comply with applicable law, including but not limited to providing assistance honouring Personal Information individual rights requests (such as deletion) as necessary for Client to comply with applicable law;
(iii) in the event Sine receives any requests relating to Personal Information directly from an individual, Sine will direct the individual to make this request directly to the Client and reasonably assist Client to respond to such request; and
(iv) Sine certifies that it understands the restrictions set forth in this section and will comply with them. For purposes of this section only:
(A) “Personal Information” means any information relating, directly or indirectly, to any identified or identifiable natural person or household, which Sine collects on behalf of Client in connection with providing the Services; and
(B) “Process” or “Processing” means any operation which is performed on Personal Information or on sets of Personal Information, whether or not by automated means.
